Notification of Copyright Infringement

Masters by IPPAWARDS (“Masters by IPPAWARDS,” “we,” or “us”) respects the intellectual property rights of others and expects users of our website to do the same. It is our policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts of users who repeatedly infringe the copyrights or other intellectual property rights of others.

In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), the text of which is available on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Masters by IPPAWARDS will respond expeditiously to claims of copyright infringement committed using the Masters by IPPAWARDS website (the “Site”) that are reported to our Designated Copyright Agent, identified below.

If you are a copyright owner or are authorized to act on behalf of one, or are authorized to act under any exclusive right under copyright, please report alleged infringements taking place on or through the Site by sending a DMCA Notice of Alleged Infringement to our Designated Copyright Agent. Upon receipt of a Notice as described below, Masters by IPPAWARDS will take whatever action, in its sole discretion, it deems appropriate, including removal of or disabling access to the material claimed to be infringing.

DMCA Notice of Alleged Infringement (“Notice”)

Your Notice must include the following:

  • Work identified: Identify the copyrighted work you claim has been infringed, or, if multiple works at a single online site are covered by your Notice, provide a representative list of such works.

  • Location of material: Identify (i) the material you claim is infringing or the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, including at minimum the URL of the page where the material appears on the Site; and (ii) the reference or link to the material or activity that you claim to be infringing and that is to be removed or access to which is to be disabled, including at minimum the URL of the page where the reference or link appears.

  • Contact information: Provide your full name, mailing address, telephone number, and, if available, email address.

  • Good-faith statement: Include the following statement:
    “I hereby state that I have a good-faith belief that the disputed use of the copyrighted material or the reference or link to such material is not authorized by the copyright owner, its agent, or the law.”

  • Accuracy and authority statement: Include the following statement:
    “I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner of the copyright or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”

  • Signature: Provide your full legal name and your electronic or physical signature.

Counter-Notification

If material you posted was removed or access to it was disabled and you believe the removal or disabling was a mistake or misidentification, you may submit a Counter-Notification to our Designated Copyright Agent. Your Counter-Notification must include:

  1. Your signature: Your physical or electronic signature.

  2. Identification of material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled (the specific URL is best).

  3. Good-faith statement: A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.

  4. Contact and consent: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if outside the United States, for any judicial district in which Masters by IPPAWARDS may be found, and that you will accept service of process from the person who provided the original DMCA Notice or that person’s agent.

Upon receipt of a valid Counter-Notification, we may forward it to the original complaining party. Unless the copyright owner files an action seeking a court order against you within ten business days, we may restore the material.

Repeat Infringers

Consistent with the DMCA and other applicable law, Masters by IPPAWARDS may, in appropriate circumstances, terminate accounts of users who are repeat infringers.

Misrepresentations

Please be aware that under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorneys’ fees.
